Welcome to Open Analytics. By accessing or using the Service, you agree to these Terms of Service and our Privacy Policy.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.
02The Service
Open Analytics is a privacy-oriented web analytics platform. You can install our tracker script on websites you own or operate to collect analytics, and access that data through your dashboard — including pageviews, traffic sources, custom events, realtime visitors, and optional features such as bot crawl monitoring and Search Console integration.
The Service includes a hosted dashboard, JavaScript tracker (tracker.js), documentation, APIs, and related tools. We may add, modify, or discontinue features with reasonable notice where practical.
Components of Open Analytics are also available as open-source software. Your use of source code is governed by the applicable open-source licenses in addition to these Terms.
03Your account
- You must provide accurate information when creating an account, including a valid email address.
- You must be at least 16 years old to use the Service.
- You are responsible for all activity under your account, including actions by team members you invite.
- Keep your sign-in credentials secure. Notify us promptly if you suspect unauthorized access.
- We may suspend or terminate accounts that violate these Terms or pose a security risk.
04Free trial, Startup program, and subscriptions
14-day free trial
New accounts receive a 14-day free trial of the Service. No credit card is required to start. After the trial, you must subscribe to a paid plan to continue accessing dashboard features.
If you do not subscribe after the trial ends, dashboard access will be paused and analytics data may be deleted after a short grace period, as described in our Privacy Policy.
Startup program
Eligible startups may apply for the Startup plan, which is free for 1 year and includes up to 100 projects, 10,000 events per month, and 90 days of data retention. Approval is at our discretion. See the Startup program page for current eligibility and limits.
After the Startup period ends, you must upgrade to a paid plan to continue using the Service. The Startup plan may also be cancelled if your account is inactive for 30 consecutive days.
Paid plans
Paid plans (Hobby, Starter, Growth, and others shown on our pricing page) include a 14-day free trial — you are not charged until the trial ends. Subscriptions renew automatically until cancelled. You may cancel at any time; access continues until the end of the current billing period.
Pricing, plan features, and billing intervals (monthly or annual) are shown on the pricing page at the time of purchase. Fees are non-refundable except where required by law.
05Events, usage, and plan limits
What counts as an event
An "event" is any data point tracked by the Open Analytics script or related ingest APIs on your website(s). This includes pageviews, page-leave events, custom events, and bot crawl events. All event types count equally toward your plan's monthly event limit unless stated otherwise on the pricing page.
How events are counted
Events are counted across all websites and projects connected to your account during your current monthly billing cycle. For annual subscriptions, usage is still measured in monthly cycles.
Plan limits
Each plan specifies limits for websites (projects), monthly events, team members, data retention, and optional features. Current limits are shown on the pricing page and in your account settings.
By selecting a plan, you agree to keep your usage within the allowances included in that plan.
Exceeding your plan limit
We continue to record events even if you approach or exceed your monthly limit — we do not silently discard your data. If your usage exceeds your plan's allowance:
- We may notify you by email as you approach or exceed your limit so you can upgrade or adjust usage.
- Dashboard access or certain features may be restricted until you upgrade to a plan that covers your current usage.
- To regain full access, you may need to upgrade to a plan with a higher event limit that covers your actual usage for that billing cycle.
- We may slow down or pause event ingestion for accounts that repeatedly exceed their plan without upgrading.
06Websites, projects, and plan features
Each plan determines how many websites (projects) and team members you can add. If you reach a limit, you must upgrade to add more.
Feature availability (such as bot analytics, Search Console integration, or extended data retention) depends on your plan. See the pricing page for details.
You may only install the tracker on websites you own or have permission to operate.
07Your data
You own the analytics data collected through your websites. We process it on your behalf to provide the Service, as described in our Privacy Policy.
You can manage, export, or request deletion of your data through the dashboard or by contacting us. Data retention periods depend on your plan.
08Visitor data and your responsibilities
When you install Open Analytics on your website, you are the data controllerfor your visitors' analytics data. Open Analytics acts as a data processor on your instructions.
You are responsible for:
- Having the right to collect and process data from visitors to your sites
- Publishing a privacy notice that describes your use of analytics
- Obtaining any required consents — especially if you enable cookie-based tracking
- Responding to visitor rights requests (access, deletion, etc.)
- Complying with applicable privacy laws (GDPR, CCPA, ePrivacy, and similar regulations)
We do not intentionally collect names, email addresses, or other directly identifying information from your website visitors through the tracker. Do not send sensitive personal data in custom events.
09Tracking modes and compliance
Open Analytics supports two visitor identification modes. You choose the mode when installing the script:
- Fingerprint mode (default):
data-use-cookies="false"— no cookies are set. Visitor identity uses a browser fingerprint hash. In many jurisdictions this does not require a cookie consent banner, but you must assess compliance for your use case. - Cookie mode:
data-use-cookies="true"— first-party cookies store visitor, session, and visit IDs. You may need a cookie consent banner depending on your jurisdiction.
You may also enable data-do-not-track="true" to respect browser Do Not Track settings. For full details, see our Privacy Policy and documentation.
As your data processor, we will:
- Process data only to provide the Service to you
- Implement appropriate technical and organizational security measures
- Assist you with data subject requests where reasonably possible
10Acceptable use
You agree not to:
- Use the Service for unlawful, fraudulent, or harmful purposes
- Install the tracker on websites you do not own or operate without permission
- Send fake, manipulated, or spam events to inflate counts or mislead users
- Attempt to gain unauthorized access to systems, accounts, or data
- Interfere with or disrupt the Service, including excessive automated requests
- Resell raw access to the Open Analytics API or dashboard without our written consent
- Upload malware, probe vulnerabilities without authorization, or distribute illegal content
- Collect special categories of personal data without a lawful basis and appropriate safeguards
- Misrepresent affiliation with Open Analytics or impersonate others
We reserve the right to suspend or terminate accounts that violate this section or that put the stability of the Service at risk.
11Our intellectual property
The Open Analytics software, dashboard, branding, documentation, and tracker script remain our property (or our licensors'). We grant you a limited, non-exclusive, non-transferable license to use them while your account is in good standing.
Open-source components are licensed separately under their respective licenses (such as MIT) as stated in the repository.
12Service availability
We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, ship updates, or briefly pause access when needed. We are not liable for outages outside our reasonable control.
13Third-party services
The Service integrates with third-party providers, including authentication (Google, GitHub), hosting, payment processing, and optional integrations you enable (such as Google Search Console). We are not responsible for third-party terms, outages, or data practices. Your relationship with those providers is separate from these Terms.
14Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOU USE THE SERVICE AT YOUR OWN RISK.
15Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
16Indemnity
You will defend and indemnify us against claims arising from your websites, your analytics data, your violation of these Terms, or your violation of applicable law, except to the extent caused by our gross negligence or willful misconduct.
17Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms, fail to pay applicable fees, or if continued operation poses a risk to the Service or other users.
Upon termination, your right to use the hosted Service ends. Your analytics data will be deleted according to our retention schedule, unless we must retain it for legal obligations.
18Governing law
These Terms are governed by the laws applicable to the operator of the Service, without regard to conflict-of-law rules. Courts in that jurisdiction will have exclusive venue for disputes, unless mandatory consumer protection rules in your country require otherwise.
19Changes to these terms
We may update these Terms from time to time. We will post the revised version on this page with an updated effective date. For material changes, we will notify active customers by email where appropriate. Continued use after changes become effective constitutes acceptance of the revised Terms.
